Q1: If one of the Joint Tenants died, how to fill in the Undivided Share box for Death Certificate lodged for registration?

A: Either the full share or wordings such as "Deceased's estate, right, title and interest of and in (the undivided shares of the premises affected)" is acceptable.

Q2: If the property is held by A and B as Tenants-in-Common in 1/3 and 2/3 respectively and A died, what should be stated in the Undivided Share box?

A: The actual shares of and in the property to be affected (i.e. "1/3" which is the share held by A in (the undivided shares of the premises affected)) should be entered.

Q3: If A and B are Joint Tenants, how should I complete the Undivided Share box if A sold his interest in the property to B?

A: We accept the completion of the Undivided Share box with wordings such as 'the vendor's estate right, title and interest of and in (the undivided shares of the premises affected)' or '1/2 of (the undivided shares of and in the premises affected)'. The description should tally with that shown in the instrument.

Q4: If A and B are Tenants-in-Common, how should I complete the Undivided Share box if A sold his interest in the property to B?

A: The actual shares of and in the property to be affected should be entered.

Q5: For whole lot, what should be stated in the Undivided Share box?

A: Nothing is required to be stated in the Undivided Share box.

Q6: If the undivided share of the property is 20/700 but only part of the property e.g. 1/4 is affected by the subject instrument, how can I reflect the same in the Undivided Share box?

A: You should state '(the share affected) of (the undivided shares of the property affected)' i.e. '1/4 of 20/700'.

Q7: For Lease/Tenancy Agreement, is it necessary to complete the Undivided Share box?

A: If the premises affected is the whole unit, the completion of this box is optional. However, if the premises affected is only part/portion of a unit, it is not necessary to fill in this box.

Q8: For Deed of Partition relating to the partition of the building into individual flats, what should be stated in the undivided shares box of the memorial?

A: The undivided shares box can be left blank.

Q9: For those properties (such as flats in Discovery Bay City) which are allotted a share of the building besides the share of the lot, is it necessary to specify both the undivided share and the share of buildings in memorial?

A: The undivided share should be stated in the memorial. For the share of the building, it is optional.

Q10: In an Assignment, A (being a sole owner) assigns 1/2 share of the property to B, where should I specify the 1/2 share in the memorial?

A: Please specify 1/2 share in (the undivided shares of the premises affected) in the "Undivided Shares" box of the memorial.
