Land Registration (Amendment) (No.2) Regulation 1996

 

1. The Land Registration (Amendment) (No.2) Regulation 1996 gazetted on 25 October 1996 which will take effect on 9 December 1996 aims at ensuring that images of land documents captured in the Land Registry's Document Imaging System are of a good quality.

2. Some of the changes introduced by the amendment may have an impact on legal practitioners or other persons engaged in the preparation of documents for registration at the Land Registry. They are the requirements for documents to be in A4 size, and printed or written in black ink on one side only of white paper or azure ledger paper. These changes have been drawn to the attention of the legal profession.

3. In the interest of the smooth operation of the Document Imaging System and the quality of the land records maintained on the system, the new requirements should be strictly complied with unless permitted otherwise by the Land Registrar. Such permission will be given only in cases where there is genuine difficulty in complying with the requirements.

4. It is generally accepted that there may be genuine difficulty for some of the following documents to complying with the new requirements:

  1. Various orders, certificates. etc., issued by courts or government authorities;
  2. Documents completed outside Hong Kong;
  3. Documents with endorsements relating to receipt or release of legal charge/mortgage;
  4. Car park layout plans; and
  5. Documents executed before 9 December 1996.
General permission has been given for these documents to be accepted by the Land Registry. There will be no need to seek permission on a case-by-case basis where they do not comply with the new requirements. Similar permission has also been given for the acceptance of documents bearing written insertions, signatures and chops in blue provided the colour of such insertions, signatures and chops is sufficiently dark not to affect the imaging process.
